With the development of the society and economy,the popularity of the Internet has also been promoted.In the process of bringing great convenience to our lives,the Internet is also a typical "double-edged sword".This requires us to objectively treat various problems caused by the Internet,especially with the rapid development of Internet technology.Internet crime activities are increasing,such as Internet rumors and crimes.Internet rumor refers to the behavior of disseminating false information on the Internet without facts.In twenty-first Century,Internet rumors were a serious problem facing most governments around the world.On the issue of cracking down on Internet rumors,the views of all countries are unprecedented.Governments have formulated laws and regulations related to the regulation of Internet rumors,aiming at making clear the root of Internet rumors and criminal activities.But "everything is too much,too late".The application of criminal law to Internet rumors must be restricted on the basis of following the basic principles of criminal law.This article is divided into four parts.The first part: this part focuses on the analysis of the definition and characteristics of the Internet rumors,and expounds the rules and regulations on the Internet rumors at home and now,and clarifies some basic concepts.The second part: this part mainly expounds the current situation of the application of the criminal law in the judicial practice of our country,and points out why the application of the criminal law should be restricted,and the application of the criminal law should be restricted from the two angles of the legality of the crime and the modesty of the criminal law.The third part: this part mainly expounds the principles to limit the application of criminal law in Internet rumors.The connotation and significance of the three legal principles are explored from the three legal principles,such as the principle of constitutionality,the principle of legality and the principle of proportionality,which provide the legal support for the subject of this article to restrict the application of the Internet rumors.The fourth part: this part of the content of the third part of the content,mainly elaborated on how to restrict the application of the criminal law under the guidance of the three principles.This part will involve the understanding of specific articles in criminal law and judicial interpretation,and give examples to explain them.
