A Study On The Participation System Of Appropriate Adults In Juvenile Delinquency In China

With the development of Youth Justice in China,the appropriate adult participation system is gradually developed and perfected in judicial practice.The practice exploration in various places has also changed to institutionalization.This paper bases itself on the current situation of the appropriate adult participation system for juvenile delinquency in China,and also examines the practical experience of overseas countries.Based on the innovation and problems in the implementation of the appropriate adult participation system of juvenile delinquency in Beijing,the author puts forward some relevant suggestions for the study of the appropriate adult system of juvenile delinquency in China.Through literature research,comparative research and empirical research methods,this paper combs the theoretical and practical aspects of the system,summarizes the relevant problems,and puts forward some suggestions to improve the system.Specific structures include the following:The first part is an overview of the appropriate adult participation system for juvenile delinquency.By discussing the concepts and functions related to this system,and combining the research contents of this paper,we get the concept,scope and function of the appropriate adult participation system for juvenile delinquency.Then,the theoretical basis of the implementation of the system is introduced.The second part is the Chinese and foreign investigation of the appropriate adult participation system of juvenile delinquency.There are differences in the legal completeness,the protection of the rights of juveniles,the role orientation of appropriate adults and the construction of the contingent.Therefore,based on the comparison of the appropriate adult participation system of juvenile delinquency in the main countries through horizontal comparison,it will provide references for the improvement of this system in China.The third part is the practice of the appropriate adult participation system of juvenile delinquency in China-taking Beijing as an example.Through combing the practice of Beijing,it has enriched and developed the appropriate adult system of juvenile delinquency in China by issuing corresponding laws and regulations,innovating the concept of work and perfecting the supporting system of the system.However,there is also a lack of clear functional orientation of appropriate adults and imperfect measures to safeguard the rights of juveniles.It is difficult for appropriate adults to follow up the whole process of a juvenile delinquency case and to improve the construction of an appropriate adult contingent,and other pilot areas are more or less similar to each other.The fourth part is appropriate adult participation system for juvenile delinquency in China consummation suggestion.Some suggestions are given for Aiming at the problems existing in the implementation of the present system.It is embodied in defining the functional orientation of appropriate adults,strengthening the protection of the rights of juveniles,ensuring the quantity and quality of the appropriate adults,and improving the construction level of the appropriate adults.
