Research The Participation Of Judicial Social Workers In The Presence Of Appropriate Adult

To avoid in the process of interrogation,litigation or trial appears in a minor violation of interrogation of the suspect,the secondary damage in the case of minors,the 2012 revision of the criminal procedure law for minors of interrogation and examination and set up a special procedure,formally established in law the right system of adults are present.Its purpose is to invite the third party to supervise the judicial organs and avoid illegal interrogation and collection of evidence.However,as the current law does not clearly define who is the right adult,it only delineates a wide range of choices.In addition,there are no clear provisions on the working concept,rights and obligations of the right adult,resulting in many problems in the practice of the right adult attendance system in China.Therefore,P district of G city organizes to carry out the pilot project of suitable adults,and tries to find out the solution to the problem through practice.In this paper,by analyzing the project results,combined with a year’s practice experience,proved by judicial social workers as the main body to carry out the relevant work can not only fit adults to protect the lawful rights of the minor criminal suspects,avoid juvenile criminal suspects in the process of judicial proceedings suffered from illegal violation goal,also will continue at the end of interrogation and trial procedure in case of tracking and intervention,the use of social work professional knowledge and skills,under the guidance of helpful ideas help underage criminal suspect out and reintegrate into society,avoid the minor criminal suspects to crime again,so as to realize the stability of the society.This practice result provides a powerful reference and practical basis for defining suitable adult subjects.On the other hand,the lack of professional judicial social workers and serious shortage of funds are also exposed in the project practice.This study starts from the integration point between the concept of judicial social work and the intrinsic value of the appropriate adult system,comprehensively analyzes the results of the pilot project in P area,expounds the advantages of judicial social work as the appropriate adult subject,and then finds that judicial social work is the best choice as the appropriate adult subject.At the same time,it summarizes and discusses the practical difficulties existing in practice,analyzes the obstacles restricting judicial social workers to give play to their advantages and the ways to overcome them,so as to make judicial social workers play a greater role and value in the presence of suitable adults.
