Research On Security And Order Responsibility Of Units

There is a large number and variety of units in China.Preserving security and order within the unit plays an important role in the stability of the entire society.After the founding of the People's Republic of China,China implemented socialist public ownership as economic system.At that time,the concept of “private” is very underdeveloped,as well as the concepts of nationalism and collectivism outstands.Forms of ownership of enterprise are generally state ownership and collective ownership.In this context,internal order of enterprises is understood as part of the social order.Police power is enforced by both local public security institutions and enterprise public security force.But after reform of economic system,system of ownership of units became diversified.The boundaries between public and private are gradually clear.The private field gradually withdraws from the public field.With the introduction of the People's Police Law of the People's Republic of China of 1995,enterprise public security force was canceled,police power is readjusted according to the principle of publicity.Internal security of units is gradually separated from public policing.In recent years,however,with the severity of the counter-terrorism situation and the frequency of malignant public order events increasing,public policing which was supposed to be separated from internal security thoroughly and clearly are still participating in the internal security and safeguard work of units,and this phenomenon is becoming more serious.For example,after the increase of subway safety pressure,the number of subway policemen has increased dramatically;frequent campus security incidents has led to the creation of campus police;after hospital woundings,hospital police stations have emerged...Security and order responsibility of the unit “being public” could lead to downplaying security and order responsibility of units and weakening consciousness,unclear boundaries between public power and private interests and the problem of insufficient police capacity at the grass-roots level would be aggravated.To figure out the reasons,legacy issues of “wholepopulation system” design during the period of social transformation,deficiency of the current internal security regulations in the theoretical level,irrational allocation and run of police power,confusions and conflicts between public and private fields,all the aforesaid reasons has led to the phenomena jointly.In fact,the unit taking responsibility for security and order has its proper meaning.The nature of the unit's “private domain” determines that the unit should be responsible for the internal security and order.What's more,unit rights and unit obligations are corresponding.And the unit internal security is an essential component of unit benefit.In addition,the scope of the responsibility of security and the subject of obligation,as well as thesafety and prevention responsibility of the personnel inside the unit,determine the legitimacy of the unit to maintain internal security and order.In order to realize the clarification of theoretical responsibility and implementation of the separation,this paper highlighted these following countermeasures.Firstly,basic theoretical issues at the legislative level should be clarified,and the responsibility subject of security and order should be clear,standards of security work should be distinct,procedure of guidance from public security department should be normative.Secondly,we should ensure that the unit should develop and strengthen the consciousness of being subject of the responsibility of security and order through multiple ways.Thirdly,public security organs should allocate police power in accordance with the principle of publicity and avoid taking on the all things of public order,public security organs should take on the role as “security guardian”.Fourthly,units should conduct rational allocation of internal security resources and ensure precautions by persons,equipment and techniques.Fifthly,units should actively explore the diversification of the path of the unit's responsibility for internal security.For example,developing internal security forces,buying security services,outsourcing the whole unit's safety and security,and so on.Problems like unclear security and order responsibility of units,ambiguity of power and responsibility of the public security organs,excessive input of police force should be eradicated.
