The Investigation Of Farmers' Professional Cooperatives' Illegal Fund-raising Criminal Cases

In 2017,our state continued to introduce strategic guidance documents on specific deployment to accelerate rural reform,promote agricultural development and increase farmers' income,and promote the construction of a new agricultural management system to ensure the healthy development of agriculture.Among them,as a national key support and protection project,the farmers' professional cooperatives have attracted much attention in speeding up the construction of new rural areas,promoting the development of modern agriculture and promoting the prosperity of farmers.However,some cooperatives make use of the relatively loose preferential policies given by the state to strive for improper personal benefits through absorbing the funds against the public with high interest rates as bait,which make the farmers' professional cooperatives deviate from the route and starting point for serving for farmers.In recent years,the most typical economic crimes in rural areas are the illegal fund-raising crime of farmers' professional cooperatives,which involves such characteristics as a large number of people,spurious fraudulence and serious consequences.The adverse effects of such crimes have seriously endangered the normal economic order and social stability of the countryside.At the same time,the high incidence of such cases also reflects the urgency of the investigation of the crime of illegal fund-raising by farmers' professional cooperatives.This paper,from the perspective of investigative practice,makes a research on the illegal fund-raising crime of farmers' cooperatives,and puts forward some feasible investigative countermeasures.The first part of this paper mainly introduces the definition and nature of the farmers' professional cooperatives and the concept of the illegal fund-raising crime of the farmers' professional cooperative type.It also analyzes the reasons for the high incidence of the cases from four aspects including the rural financial situation,the farmers themselves,the government supervision and the cost of the crime in the light of the prominent situation and the characteristics of the cases in recent years.The second part of this article dissects and summarizes the main criminal means of the farmers' professional cooperatives based on the analyzing of the operation mode of crime illegal fund-raising.The third part of this paper,starting from the practice of investigation,and based on the experience of handling relevant cases,puts forward the difficulties of investigating such cases.Finally,the fourth part of this paper,combining with the situation and problems in investigation practice,comes up with several detailed investigation countermeasures.
