Food is the most basic material element on which people depend for survival.In recent years,food insecurity in our country has occurred frequently,which not only has a bad effect on the life,health and safety of the ordinary people.It has also affected the social order and social harmony in our country.In our nation,food safety has become a social issue of national concern.We should re-examine the advantages and disadvantages of existing criminal law in preventing and cracking down on such illegal activities.Criminal law,penalty crime and ensure national security,plays a very key role in the legal control system of our country.The effective implementation of other laws can not be separated from its backing and safeguard.Based on its severity,it has a special role in preventing and combating crime,but in practice,there is a lack of valid connection between criminal law and other laws and administrative regulations.A considerable number of food safety crimes cannot be included in the scope of criminal punishment,which also makes the punishment slightly lagged and powerless.Facing the arrogance and rampant situation of such crimes,the "Criminal Law Amendment(8)" has developed.In view of this kind of crime has made the importantrevision and the supplement from the legislative height,the amendment promulgated has played the bridge link function,to some extent has made up the food safety domain related law insufficiency,In 2015,the Food Safety Law,which was revised again in 2015,was promulgated,with stricter and more perfect provisions,and more severe administrative legal liability for violators.Three years later,Although the momentum of crime has slowed down,some food safety crimes are still being committed,which also shows that the legal network is not strict enough and that there is still a long way to go in the fight against food safety crimes.Therefore,this paper will analyze the causes,characteristics,legislative problems and deficiencies of this kind of crime.Comparing the legislative models and advantages of foreign countries in criminal legislation,drawing lessons from and absorbing legislative achievements,attacking the puzzling issue" of China's food safety with the legislative experience of extraterritorial states,and defending with the severe criminal law the social problems that the people are most concerned about.Let Chinese people have a healthy body,feel that safe food is really improving,"buy rest assured,eat safe" is no longer a slogan.Moreover,putting forward my own superficial views and suggestions cope with this kind of crime in theory for our country.
