Research On The Problems Of Responsibilities Of Qualified Products

With the rapid economic development,the variety of products is becoming more and more abundant,which brings people's life.Some social problems come one after another,leaving consumers more uncomfortable that many products with "qualified" labels still exist that cause damage to others Risks,product quality problems have caused people's anxiety and even panic.Clear responsibility for product liability in order to safeguard the rights and interests of product consumers,improve product liability system,establish a good market order,in line with social development.This article will mainly determine the qualified products,summarize the theoretical foundation of the predecessor,combined with case analysis of product rules and principles.This article intends to research and compare the product liability law in our country and the related foreign achievements,and then combine the domestic situation with our country to put forward the reasonable theory suggestion to our country product quality related legislation.This article analyzes the status of the responsibility of qualified products in our country,points out some imperfections,puts forward some own understanding of this issue based on the theory of the predecessors,and puts forward some suggestions on the legal regulation of the product liability of qualified products in our country.From the perspective of content structure,this paper can be divided into six parts: the first part is the introduction of the paper,the main content is to introduce the background,significance and current situation of the research.The second part mainly defines the basic characteristics of product liability and concept,followed by the "qualified" and "unqualified" product,product defects and product defects,analyzed the basic theory,comparative study;the third part mainly introduces and analyzes the developed countries legal policies for product liability issues,the United States and Japan as the representative,comparative analysis,draw for China can learn from the experience;the fourth part mainly analyzes some problems at present in our country the problem of product liability legal regulation and the existence of the special provisions of the qualified product liability.The fifth part,mainly from the legislation,the judicature,the law enforcement,the concept of law,and other aspects of the problem of product responsibility for our country to solve suggestions and countermeasures.The last part is the conclusion.
