Research On The Selection System Of Judges In China

The purpose of the court is to maintain judicial authority,realize social justice,and finally realize the rule of law.The premise of this is the quality of the judge in the court.The high quality of judges includes both legal professional quality and inner moral quality.Therefore,we not only require the judges to have profound legal expertise,but also require that they have lofty moral principles.Because the judge is exercising the right of trial,he decides the guilt and innocence of a man.To improve the quality of judges requires us to professionalize the judges.The professionalization of judges is the goal that Chinese legal workers have been pursuing,and it is also an important part of realizing the rule of law.However,due to the history and culture of our country,there are many problems in the construction of judges in our country,and the selection system of judges is an important way to solve this problem.It is of great significance to realize the professionalization of judges and restore judicial credibility.This article is divided into four parts,the first part aims to introduces the judge selection system,including the meaning,characteristics,content and so on,and the necessity of implement the judge selection system,the second part of the United States and continental legal system of Anglo-American law system of Germany's comparison of the judge selection system,to absorb and draw lessons from foreign beneficial experience of the development of the rule of law,to provide reference for the improvement of the system of judge selection point of view.The third part analyzes a series of problems existing in the selection of judges in our country,including the selection procedure and the problems existing in the relevant supporting measures.Finally,a series of related Suggestions are put forward.It is hoped that the improvement of our country's judge selection system can help.
