Research On Compensation Liability Of Real Estate Registration Error

The system of compensation liability of real estate registration error is coming into being by the action of the applicant and the staff of registration office,which causes,the real estate trade opportunity to miss,namely,generally,at least,the property loss.Different behavior of registration error cause differing degree in property loss and there are three behavior patterns of causing property loss,namely the behavior of applicant for registration,third party,registration agency,which is the behavior pattern NO.1 of real estate registration error,or the behavior of registration agency,applicant for registration,which is the behavior pattern NO.2 of real estate registration error,or the behavior of third party,registration agency,which is the behavior pattern NO.3 of real estate registration error.Due to the factor of the relevant laws of the compensation liability of real estate registration error being imperfect,which cause the disunity in the compensation liability of real estate registration error's nature of,the principle of imputation,the liability form etc.,there is some discretionary power in Court in dispute settlement of the compensation liability of real estate registration error and to solve the compensation of it.Shelving disputes is priority and the sate bears the supplementary liability and shared liability for the damage conditionally,which becomes the latest practice in the study on compensation liability of real estate registration error in China and provides an important guarantee for the further prosperity and development of the real estate trading market in China.
