Although our current legislation has stipulated the liability for registration error of the real estate registration agency, because of the provisions are too general, and cross regulation phenomenon exists in the public law and private law, leading to the confusion of law application in judicial practice. Through the study and analysis of the integration of practice of the relevant cases, found that something about the main causes of this situation are not clear. The concept of "registration error", registration review patterns and the nature of the liability, imputation principle, scope of compensation, etc. are not clear. For correctly applies law to solve the compensation disputes for registration error in the practice, in this article, the author firstly analyzes the legislative status quo of the compensation system, finding out its system defects, followed by analysis of these problems comprehensively, then give a re-interpretation of our country’s compensation for the current real estate registration system from the legislative value of the system and the practical operability, finally,through theoretical analysis and combined with the concrete practice, putting forward some related suggestions to improve the system of the real property registration compensation. |
