| "Property law" article 21 of the regulation of registration error:"the parties to provide false material to apply for registration,damage to others,shall be liable for compensation.Because of the registration error,damage to others,the registration organ shall be liable for compensation.After paying compensation,the registration organ may recover from the registration errors caused by people."Registration error system is very important in the property law registration system of a system,it carries the holder in the registration mistake there is a reasonable and legitimate to maintain their own rights and interests.Article 21 property law establishes a system of real estate registration mistakes in China:the first paragraph by the parties in what circumstances need to be liable for damages;Registration organ mistake as prescribed in paragraph 2 of the liability for compensation,and after the responsibility shall enjoy the right of recourse against the registration mistake people's.Although the property law article 21 affirmed the registration organ for error registration shall bear the liability to pay compensation,however,is too rough,the registration organ liable for the properties,the imputation principle,the responsibility scope of the provisions and relief way and so on,so will cause a lot of trouble in practice,the property law of the provisions of this article is faced with some test.This paper,(1)understanding of the "property law" article 21 regulation;(2)the nature of the real estate error registration damage compensation defined;(3)real estate error registration damages imputation principle;(4)real estate error registration damage compensation liability form,the four aspects of the nature of real estate error registration for damages to comb,trying to clear this article applies the main body,the applicable conditions and legal consequences,in order to help the law practice,the topic and the judicial practice to form a better solution. |
