Research On Legal Protection Of Internet Financial Consumers' Right

The emergence of Internet finance has achieved deep integration of internet innovation and traditional financial industry.It is conductive to stimulating the market innovation ability,creating new business formats,innovating service modes,and providing a new engine for economic development.After the financial crisis,the importance of protecting financial consumers ' rights and interests has been recognized and advocated.Countries around the world are hurried to pass remedial legislation to enforce the protection of consumers' rights and interests.In China,with the growing fierce competition of financial market and the innovation of financial products,financial agencies interact with each other and further blur their boundaries.The development of Internet finance,represented by Internet payment and P2 P Internet lending,also facilitates the integrated management development of finance.Under such a background,due to the advantageous position of financial institutions and the information asymmetry,the legitimate profits of financial consumers are frequently breached because of their lack of expertise.How to protect the financial consumers against the financial market risks has become an urgent issue to be solved by our country in the post-crisis era.In this paper,the particularity of the protection of the rights and interests of Internet financial consumers was analyzed at first,and the concept of Internet financial consumers was proposed by comparing with general financial consumers.Then,the particularity of Internet financial products was investigated to highlight the particularity of protection of rights and interests of Internet financial consumers.In addition,the current situation of the protection of the rights and interests of Internet financial consumers in China was studied,and some urgent problems to be solved were put forward,so as to highlight the urgency of legislation and financial regulatory reform.Finally,the experience of the United States,the United Kingdom and Japan in protecting the rights and interests of financial consumers was outlined,so as to draw important enlightenment that are conducive to the protection of the rights and interests of Internet financial consumers in China.With the analysis from the establishment of protection principle,clearing the rights and obligations of different parties,realizing functions of industrial associations and improving the judicial system,the idea of protection of Internet financial consumers' rights and interests in China was put forward and relevant improvement suggestions were made.
