Withthe continuous development of social demand,generation driving as a new business model arises at the historic moment.Because of legal problems such as inadequate,there are often many disputes to resolve between the owner and the generation of driving,the current legal provisions for the generation of driving less,so,this paper determined the "legal responsibility and standard of driving on behalf of the proposal" as the theme.In this paper,the plan of driving from the current situation,China's motor vehicle generation causes and types of problems of traffic accident liability,comparison of extraterritorial driving services on behalf of the relevant provisions of China's motor vehicle driving on behalf of now to find out the current situation and existing problems,put forward to perfect the road driving on behalf of tort legislation.The first chapter of this paper is mainly about the concept of motor vehicle driving,including the characteristics of motor vehicle driving,analysis of the causes of driving,the main situation and theoretical basis.In Chapter 2,in different circumstances,the motor vehicle driving on behalf of the tort liability of infringement in the case of the generation of driving the process for driving on behalf of human rights,the owners damaged interests impaired,driving on behalf of other aspects of damage to the interests of the accident.Then,the author analyzes the imputation between the driver and the owner,and analyzes the case.The third chapter mainly analyzes the mode of responsibility sharing under the condition of paid for driving,and makes a certain analysis of foreign regulations.In the last chapter,the third chapter puts forward the problems,and from the current domestic road driving on behalf of infringement of legislative and judicial suggestions angle,put forward to strengthen road driving on behalf of tort disputes the judicial activism,strengthen management and standardize the industry,for the generation of driving the domestic tort shortcomings are analyzed,that strengthen the generation driving industry the insurance relief,and driving on behalf of the propaganda.The purpose of this paper is to improve the current laws and regulations related to the management and regulation of driving behavior,so that driving behavior can be better regulated,and then better serve the citizens.
