To build an innovative country,promote industrial transformation and upgrading,and promote the transformation of scientific and technological achievements,the protection of the legal system is indispensable.The establishment of the service invention system in our country was relatively late,and there were many problems in the reward system for service inventions that needed to be resolved.With the improvement of legislation and awareness of protection of service inventors,especially the newly revised "Promotion of Scientific and Technological Achievements Conversion Law," the State has set up research and development institutions and institutions of higher learning to improve research capabilities and achievements.High requirements,intensify incentives for scientific and technological personnel,increase the proportion of rewards for scientific and technological personnel,ensure that incentives can be put in place,and in turn increase China's ability for independent innovation.Although the proportion of China's job invention has increased,in the world scope,China's job creation still has a greater development space.And the reward system of job invention has more problems,many units can not really face up to the problem of reward,inventors or designers should not be guaranteed reward,directly affect their creative enthusiasm.The article tries to improve the present situation from the aspects of legislation and practice,fully mobilize the enthusiasm of the inventor of the job,guarantee the legitimate interests of the job inventor,promote the development of enterprises and strengthen the comprehensive national strength of our country.The article first analyzes the research background,significance,and status quo of the reward system for service inventions,and points out the importance of the distribution of benefits in service inventions and the existing common problems.Second,it traces the historical origins of the reward system for service inventions,and the invention of service in China.The legislative status quo and implementation status of the reward and compensation system are discussed.Furthermore,the problems in the legislative system of the reward system for service inventions in China are pointed out.In conjunction with the cases injudicial practice,the relevant laws are not fully implemented and are not implemented in the system.The lack of main content points out that China's service invention reward system needs to be further improved;through an overall analysis,it introduces foreign advanced legislative experience and better grasps the universality of the service invention reward system.Finally,it puts forward sound suggestions for the existing legal provisions and narrows the differences in legal standards between different laws and regulations.In practice,it is necessary to exercise reasonable restraints on prioritization of agreements and penalties must be embodied.Reward compensation calculations need to be further developed and mature.Payment should be fair and reasonable.
