Internet + Against The Background Of Enterprises Abusing The Market Dominance Of The Monopoly Law

Over time,China has basically entered the Internet age.Against this background,facing with a transformation problem,many traditional enterprises try to integrate them with the Internet technology to keep a competitive advantage,no matter which industry they belong to.In this process,many of those companies have successfully transformed themselves into the second generation of Internet enterprises,gaining more market resources but gradually taking the road of monopolizing.Under this context,the phenomenon of abuse of market dominance emerges,and this paper is to study related issues of the abuse under the Anti-Monopoly law.This paper,based on the related theory of abuse of market dominance in the anti-monopoly law,is to interpret the definition of "Internet +",the enterprise characteristics under the "Internet +",the definition of “abuse of market dominance”,and the rules for prohibition of abuse.On this basis,this paper instructs the status of the abuse in the present under the "Internet +",and starting from "tencent and qihoo 360" case,this paper finds monopoly price,overcharging,refused to trade,forced trading,and other existing problems.This paper also study on the transformation tendency of value of the Anti-Monopoly law under the background of "Internet +",and finally find the corresponding solutions.Because the content of our anti-monopoly laws and regulations in not sufficient,and the relevant legislative experience is blank,the economic effect of the anti-monopoly law is not outstanding and not completely certain,thus the anti-monopoly law chooses a more principled legislative model,remains many problems to be discussed.This paper refers to international excellent cases and mature experiences,combined with the national conditions of China,and at the same time get some foreign experience,foreign excellent cases and related research results.By comparing and combining the national conditions of our country,we get some suggestions that conform to our country's contemporary law legislation and enforcement,so that we can perfect our Anti-monopoly Law starting with its implementation details.
