In recent years,with the rapid development of our country's economy,the number of cases of Mass torts has increased greatly.But,but our country's legislation on Mass torts is very fragmented.In particular,the damage compensation system is not sound.The existing damage compensation system has some limitations in punishing,preventing torts and filling up the damage to the interests of society as a whole.The occurrence of Mass torts has the characteristics of contingency and diversity.The Mass torts cases in different fields often show different external characteristics.The handling of these cases requires a more systematic system.Today,how to use the system to make up for the adverse consequences caused by the free market economy,this is a systematic project.It is an important part of the system to improve the damage compensation system of Mass tort.From the perspective of historical development,the developed western countries have developed earlier,and the treatment of large-scale tort cases is more experienced than our country.And some western countries have some advanced legislation and a better case for reference.Mass tort involves the field of law,including not only the domain of the legal entity law,but also the economic law,the litigation law and even the criminal law.This article is mainly from the angle of tort liability law,and part of the relevant laws of economic law.The first half of this article is written from the basic theory of Mass tort,the system of damages in tort law and the issue of damages.Then,Through the analysis of our country's legislation and theory,the author combs the current situation of the theory and practice of Mass tort.Combing the foreign data with the laws and jurisprudence of some countries of common law system and civil law system.Finally,through the analysis of these data,summing up the perfect suggestions.
