The Perfection Of Judge's Responsibility System In China

In today's society,judicial activities are an important means of achieving fairness and justice.Judge as a national judicial power of the exercise,is an important member of the judicial activities.The judge's judgment is not only directly related to the interests of the parties,but also affect the order of society as a whole.The system of judges' accountability is the guarantee of exercising the judicial power by the judge.The new round of judicial reform involves the system of accountability o f judges,the establishment of a judge system of life-long responsibility and gradually established a provincial level judge disciplinary committee.However,there are still many problems in the subject,the subject,the procedure and the measure of the judge's accountability system in C hina,which is relative to the system of judges of the United States,Germany and Japan.Based on the analysis of foreign related systems,this paper puts forward suggestions to improve the system of accountability of judges in China.First of all,elaborated the basic theory of the accountability of judges,including the definition of the concept of the concept of judges,the characteristics and the value orientation of accountability.Secondly,the study of extraterritorial related systems,and analysis of the reference to China.Thirdly,it analyzes the current situation and problems of the system of accountability of judges in C hina from four aspects: the subject,the content,the procedure and the measures.Finally,in order to solve the above problems,we should put forward specific suggestions,including standardizing the relevant legal documents,clarifying the main body,standardizing the reasons for pursuing them,reconstructing the formalities and adjusting the recovery measures.The main contents include the conversion of the judge from the chaos of the wrong case into the standard of misconduct of the judge,as well as adjust the power of the discipline inspection and supervision departments within the court and the judge's disciplinary committee and so on.
