Research On The Legal System Of Safety Production

With the revision of the "Work Safety Law" and "coal law",the construction of the legal system for safety production has also been put on the agenda.In 2016,the Central Committee of the Communist Party of China and the State Council issued the opinions on advancing the reform and development in the field of safety production,and proposed that we should improve the system of laws and regulations,and establish and improve the safety and production laws and regulations.Therefore,it is of practical significance to study the legal system of safety production.Based on the basic concept of production safety,the production safety law,legal system,safety legal system,through the text analysis method,logical analysis method,literature research,empirical research,comparative research methods,in general conditions based on the construction of legal system,put forward the form element,reasonable production safety law the system should have the elements of the content,value factors and basic level construction.Based on the current production safety legal system in our country as the object,the architecture of the system exists in the form of legal system is not systematic,the law is difficult to transverse to the edge,the method is difficult to quotvertical,different ranks of legal norms can not play a corresponding role,the construction content of some legislative content obsolete and some new situations and new problems between formulation of new legislation,the basic legal system and legal system of branch Department of convergence is not tight enough,legal system and legal system is not synchronous,branch of legal system,the lack of repeated technical regulations system,value function,it is difficult to clarify the relationship between the basic law and special law,function the system is not unified and reason analysis.And put forward the main task of perfecting the legal system of our country's safety production in the aspects of carrying out the guiding ideology and strengthening the legislative democratization.
