Production Safety Accidents Legislative Studies

With the rapid industrialization in recent years, all industries in China enjoys a strong momentum of development, while due to China's productivity at a poor level, the weak awareness of work safety in the society and the mostly labor-intensive enterprises in the state, the production safety accidents frequently occur. Emphasizing on the work safety, China keeps improving its legislation on production safety accidents. In spite of an original law system of work safety and a series of primary administrative disciplines, the legislation still bears plenty of deficiencies. Several problems are exposed in the practical process, especially the legislative problem that springs from production safety accident. Firstly, current primary law on production safety accidents falls short of the authority. Secondly, the administrative regulation on production safety accidents may lead the practices in a wrong direction. Thirdly, the regulation should be advanced in a systematic approach. Fourthly, we find a critical deviation over the definition of the production safety accidents.Upon above problems, the article intends to analyze the nature of production safety accidents, thereby exploring the existing problems on the law system of production safety accidents and a solution of improvement.
