On The Perfection Of Property System Of Farmers' Cooperatives In China

Since the reform and opening up,China has carried out fruitful reform in the economic field and achieved remarkable achievements.The reform and development of rural economy has been the top priority of our economic work.For a long time,we have summed up the problem of rural reform and development as the problem of agriculture,countryside and farmers.In order to solve the problem of "three farming",China has conducted a variety of beneficial explorations,among which the strong support for the organization form of farmer cooperatives is one of the important measures.Farmers' cooperatives have always been favored by most countries because of their special attributes and advantages.As an important form of cooperative economy,cooperatives have experienced a tortuous process in the development of our country.Since the reform and opening up,cooperatives have gradually been given new meaning and mission.The implementation of the farmer's cooperative law in 2007 provided a fundamental institutional support for the rapid and healthy development of China's farmers' specialized cooperatives in the new period.In the eight years since the implementation of the law,China's farmers specialized cooperative has presented a good situation of rapid development.Farmer cooperatives in promoting agricultural development,increase farmers' income,and played an important role in building new socialist rural areas,has become the backbone of the construction of new agricultural management system and lead farmers to participate in market competition both at home and abroad of modern agricultural operation organizations.However,with the implementation of the law and the development of farmers' cooperatives,the problems of farmer cooperatives are gradually emerging.Although the relevant state departments and provincial(autonomous regions and municipalities)after the implementation of the law has successively formulated the related laws and regulations and local regulations,such as the ministry of agriculture has established the cooperative demonstration articles of association,the ministry of finance formulated the financial accounting system,the state administration of taxation has established cooperative tax policy,the state administration for industry and commerce formulated the co-op registration management system,etc.,the vast majority of provinces(autonomous regions and municipalities)introduced a cooperative local regulations and support cooperative development of concrete opinions(our province also announced in 2014 the implementation of the regulations on the farmers' cooperatives in hebei province).However,the implementation of these regulations can not solve the problems of the law itself,and can not adapt to the actual needs of the development of farmers cooperatives.In the current "public entrepreneurship" and "innovation" spring tide of The Times,Our country farmer cooperatives must develop and innovate further in the face of the changing of the cooperative innovation practice.So the modification of the current legal system has become very urgent.As a type of economic organization which is fundamentally different from other economic organization forms,farmer cooperatives show their own characteristics and advantages in the property system.From the point of view of property relations,it can be briefly summarized as the internal property relations of cooperatives and the external property relations of cooperatives.No matter from the perspective of internal property relationship open or from the perspective of external property relationship,inevitably involves the cooperatives,such as property right subject,right content,scope,property responsibility,cooperative end system,the ownership of the state financial subsidies and processing and so on.This article analyze main problems of property system in our farmer cooperatives through analysis of farmer cooperative property system and the property system of existing rules of farmer cooperatives.on this basis,the key proposed consummates our country farmer cooperatives property system and advice.The author thinks that should perfect farmer cooperatives in the property system,should first make clear the essential attribute of farmer cooperatives and function,on the basis of clear farmer cooperatives legislative model,focus on perfecting the rights of the farmers cooperative system of the subject system and the right to object.
