Study On The Reform Of The Court Judicial Responsibility System

Implemented the reform of the judicial system,changed the original court judicial accountability system,to maintain the independence of the people’s courts make trial run in the direction of development,it is normal to the needs of the court proceedings,also need to maintain a fair and just,and promote social stability.Under the new operation mechanism,combining the reality of our country national condition,through system reform,the specific number of justice lifelong accountability mechanisms and misjudged cases shall be investigated for the establishment and perfection of the system,the preliminary implementation the new interpretation of the court judicial responsibility system,make the court work on a new step.But reform is not plain sailing,it also exist some defects,such as the judge work pressure problems to be solved,the judge took the security problem still exists,the trial team formed it become a mere formality,the responsibility of the other staff of the court regulation is not clear,the judge held accountable punishment mechanism is yet to be perfect,etc.,these are our problems which should be solved in the reform of the process.In this paper,from two angles puts forward preliminary Suggestions on the solution of these problems: To establish perfect and efficient judicial responsibility system,establish guarantee mechanism of role of form a complete set.From the Angle of the work and the external pressure to continue to maintain independence of court jurisdiction,to establish the responsibility of the unified standards and effective responsibility identification system;From since the policemen angles of "security" and the improvement of motivation,fully tapping the normal function of the court judicial system reform.In this paper,the main content is divided into four parts,the first part is an overview of the court judicial responsibility system,from the aspects such as concept and characteristic,content,historical evolution,the summary to the original court judicial responsibility system;The necessity of the second part is the judicial system reform,the existing judicial system,responsibility system mechanism,the misjudged cases investigated lifelong accountability,accountability benchmark problems,independent jurisdiction,there are still some defects such as the court has the necessity and urgency of the reform;The third part is the reform of the judicial system under the background of the court judicial responsibility system reform of content and meaning,and preliminarily discusses the embodied in the judicial practice of the reform exist deficiencies;The fourth part is aiming at the shortcomings of the practice embodies preliminary improvement measures are put forward.
