The Difficulties And Countermeasures Of Homicide Cases On Investigation And Evidence Collection

As one of the serious violent crimes,Homicide cases have severe negative influence on social society.The public security organs put forward the "the homicide cases must be cracked".The public security organs always put the homicide detection work as an important position on the fight against crime and the maintenance of social order.In recent years with the case of injustice,wrong cases and acquittal,non-prosecution cases appear on society,which indicates that the homicide investigation and obtain evidences is still certain problem,the quality of homicide cases has to be further improved.Since 2005,the Ministry of Public Security has carried out a series of dossier evaluation activities of the 12 th national homicide cases,through the rehearsal found out that the existing experience and lessons of the homicide investigation,to further improve the quality of homicide cases,which designated direction and goals.Based on the above considerations,this paper takes the national homicide cases in recent years as the model,takes the investigation and forensic work of the homicide cases as the center of the research,and adopts the empirical research method is the linking theory with practice case to carry on the deep research of the problems on the crime investigation.The This paper starts from the concept of homicide and homicide detection and puts forward that the four basic requirements of procedural investigation and evidence collection must follow the legal process,comprehensive and objective,active and timely,detailed and the form of evidence is more diversified,Evidence of the tightness of the chain requirements stronger evidence to prove the truth standard are the four higher characteristics.This paper analyzes the general problems of the current homicide cases and forensic work in the recent years,which is the outstanding problems in the four aspects of scene investigation,investigation and interrogation,evidence collection and custody,and evidence chain construction.Finally,according to the author's practical experience in criminal investigation and pre-trial department,which puts forward the countermeasures to strengthen the work of investigating forensic evidence in scene investigation,investigation and interrogation,physical evidence custody and evidence chain construction.In addition,from strengthening the sense of evidence,besides,to strengthen the internal auditing,to explore the inspection authorities to guide the point of view in advance to improve the quality of homicide cases,which propose some opinions and suggestions.
