Research On Current Problems Existing In Papers Of Civil Judgment With Suggestions On Improvement

Currently,as the fast development of Judicial Reform in China,with a more thorough and further judicial openness as an irresistible trend,effective judgment documents online have become normality through the tool of institution.Therefore,judgment documents appear in public view with an unprecedented transparency,which strengthens their quality requirement.Paper of civil judgment regulates civil legal relation where all parties as equal subject,which makes its distinctiveness from other types of legal documents.Among all the legal documents,Paper of civil judgment is much more closely related to people's life and directly involved in their interests,thus is easier to arouse controversy.In trial practice,unpersuasive judgment papers all too often appear,triggering heated debates in public media,or even hidden peril of letters and visits.Based on judicial practices,this thesis empirically analyses some typical problems in papers of civil judgment arising from legal practices,further analyzes the causes and try to propose improving strategies according to various aspects.Therefore,this thesis aims to explore ways of documents' writing that can further withstand people's judgments and reflect legal spirit in our country.Based on a careful review of civil judgment document stacks in China,the author thinks the problems in papers of civil judgment mainly lie in the following aspects: first is nonstandard language.Second is insufficient reason.Third is lack of personalization.To solve the above problems,this thesis attempts to put forward constructive proposals for the improvement of civil judgment through reason analysis and feasible strategy exploration.Furthermore,to improve the quality of civil judgment documents,merely focusing on the paper itself is not sufficient,much more attention should also be taken on the improvement of those paper-makers,perfection of related institutional construction,enhancement of judicial openness and so on,thus,to further guarantee the superior quality in making papers of civil judgment.
