The Connotation, Composition And Sign Of Judicial Civilization

This paper attempts to answer the question what is the judicial civilization,what constitutes the judicial civilization and what is the sign of the judicialcivilization. The author tries to build the basic theoretical framework of judicialcivilization by answering these questions.To answer these questions, the author uses a semantic analysis method,comparative research methods, methods of historical research, value analysismethods and other methods. At the same time, the author also learns from the studyof ecological civilization and legal civilization. The innovation of this paper is todeeply concern about the overall design in the field of judicial civilization and thepractice of judicial civilization. The author attempts to accomplish this task bystudying the basic theory of judicial civilization. We have not a clear vision for thejudicial civilization, though we have been talking about judicial reform for a longtime. Perhaps, every legal professional has his or her own empire of laws inmind.Judicial civilization as the target of national construction should have a generalrule to practice, otherwise the construction of judicial civilization would loseeffectiveness. The author is trying to find the general rule to practice,though it ishard to be accepted by everyone. The judicial civilization should be the direction andgoals of judicial modernization, furthermore, it has a powerful influence in judicialmodernization.Judicial civilization belongs to political civilization. It is the civilization in thefield of national rule and governance, so the core is the civilization of the judicialsystem. The importance of justice lies on the practice, therefore, the judicialcivilization should pay more attention to the practice, which is also the focus of thisstudy.The key issue of this paper is to define the connotation of judicial civilization,which is the foundation the research. How to find out the representative andsignificant elements in the field of judicial civilization is the key point of this study. The modern judicial civilization is mainly based on the western civilized discoursesystem. Finding out a balance between the western civilization and Chinesecivilization requires considerable wisdom and diligent study.Through a series of studies, I believe that judicial civilization is a state ofcivilization should be achieved. Specifically speaking, it should be a judicial activitycentered on the trial activities. And also,it should adapt the current stage ofdevelopment of human beings, promote social development, settle disputes, reachthe Identification of the judicial system. Judicial civilization consists of five parts,mainly as the judicial theory, the judicial system, judicial profession, the judiciary,judicial concepts.Judicial civilization characterizes as equal justice, evidence referee,respect and protection of human rights, judicial openness, justice and efficientjudicial predictability.
