Natural resources and environment are closely related to human life and death,as General Secretary Xi stressed: environmental problems should not be belittled.Recent frequent water pollution in Taizhou,Jiangsu Province,pollution in the Tenggari Desert,dumping of garbage from the Yangtze River.The frequent occurrence of such cases reminds us that the environmental pollution problem in our country is very serious,which has not only shocked the Chinese people,but also posed a serious threat to public health.And has also led to a higher level of public demand for environmental protection.In the face of the increasingly severe environmental situation,the state has adopted unprecedented severe administrative means and issued and revised many laws to carry out environmental protection work.However,due to various complicated reasons,many high-pollution and energy-consuming enterprises and projects still exist in China.How to make these enterprises and projects disappear,mobilize their sense of responsibility,guide them to take the initiative to protect the environment and cherish natural resources,This problem has become a hot issue,and green credit is a creative system proposed to ease the contradiction between economy and environment.The green credit system is a series of national and local policies,system design and operation practice,which is introduced by the bank credit means to achieve the goal of energy saving and emission reduction.The specific manifestations in China are as follows: first,for enterprises and projects that do not meet the environmental protection conditions,the state,through macro means,requires banks and other financial institutions to strictly examine and verify,and reject the establishment of such related business projects(for loans already issued,Adopt other means to recover as much as possible;second,promote the implementation of clean energy or low emission and low pollution projects according to the principle of retention control,promote merger and reorganization of industries such as overcapacity,transformation and conversion of production or through technological transformation,etc.A kind of environmental protection economic means.Circular economy,green economy and low-carbon economy are the main contents of green credit system in China and play an important role.There is no doubt that the green credit system is the historical choice no matter in the strengthening of the global environmental protection consciousness or under the guidance of 19 th CPC National Congress spirit China's economic transformation is strong.In order to fully discuss how to promote the legalization of green credit system in China and the great significance to the economic development of our country,the author mainly adopts case analysis,comparative demonstration and other research methods in the writing process of this paper.The full text consists of three parts: introduction,text and conclusion,in which the text is composed of five chapters.The first part summarizes the basic theory of green credit system.First of all,it shows what green credit is,how to determine the concept of green credit system,then briefly expounds its manifestation,and then analyzes the characteristics of green credit system from the angle of view of economic law.Finally,the importance of developing green credit system is put forward.The second part briefly explains the situation of legislation and operation of green credit system in China.In this chapter,the author focuses on the historical evolution of China's green credit system,through the production of forms and charts to show the formal image of our country in the development of green credit system,Some successes and facts at the national and local levels,as well as in the banking sector.The third part,on the basis of the second part,extends the relevant legal provisions and analyzes the deficiencies in the development of green credit system in China.This chapter mainly enumerates and analyzes the problems existing in the legal provisions of China's green credit system,including macro and micro aspects,which pave the way for the writing of the following chapters.The fourth part summarizes the national precedents that the green credit system has made more successful.After combing and comparing,it reflects on the following five countries: Britain,Canada,Japan,Germany and the United States.Drawing lessons from the practical experience of these countries in the legal level of the system,through comparative analysis and combining with the facts of our country,the author draws a systematic conclusion that the legal conception of the green credit system is improved.Our country should learn from these five countries and draw lessons from the beneficial direction.The fifth part,through the elaboration of the four part of the preceding article,recognizes some inadequacies in the green credit system in China,which should be changed from administrative policy intervention to legal restriction and supervision.From the actual conditions of our country and the current situation of environmental protection and the idea of people's understanding,we should refer to the five countries in the system.In order to improve the legal aspects of the green credit system in our country,the following suggestions are put forward from two points of view: first,the concept and basic principles of the legislative model should be clearly adopted on the macro level;and second,on the micro level,the legal evaluation system should be perfected,and the supervision and management should be strengthened.Construction of information disclosure and sharing system,establishment of incentive and punishment system,etc.
