Sustainable development has become a consensus in the world today. With the rapid development of our country’s economy, the human survival environment is deteriorating and covered by haze. It is becoming increasingly obvious between the sustainable development of economy and the environmental unsustainable development. Therefore, the government is trying to take various measures to strengthen the blow for environmental polluting enterprises. Due to attaching importance to economic development but looking down on environment protection, some local governments still allows some highly polluting, energy-intensive enterprise’s long-term development in order to boost the development of local economy. On the one hand, under the pressure of the local government, On the one hand, these polluting enterprises have been provided by banks as the main financer. On the other hand, local banks have not been considering the development of green economy, and have offered loans to them for their own interests. However, the development of green economy is a effective way to promote the economic development of our country and prevent the control of environmental degradation. Therefore, it is the most effective measures to put forward that green credit could contain the expansion of the highly polluting, energy-intensive enterprise.However, there are many problems about green credit in our country at present stage. For example, the operability and execution of green credit policy is not strong, which pay more attention to the control of financial risk caused by the environmental problems. But how to implement the preferential green credit products is lagging, lacking of corresponding green financial products. Not only do we lack the unified evaluation standard of the green credit, but also there is no effective mechanism of rewards and punishments, and no sound mechanism of information disclosure and information sharing. The main problem is that there hasn’t been a specialized legal for green credit. What’s more, the content of the green credit isn’t reflected in a related environmental protection law. Therefore, on the basis of learning foreign successful experience, we should attach great importance to the construction of laws and regulations as well as to the establishment of environmental standard system and so on. We must constantly improve and promote the execution of the existing green credit, and build the unique legal system of green credit in our country. The study in the paper is based on the fundamental in the economic concept of sustainable development, the bank’s environmental social responsibility, which carries on the present situation of the green credit in China’s industrial bank, green credit abroad, and green credit in commercial bank somewhere in China by adopting several research approaches including comparison, empirical analysis, case study and induction etc. This article puts forward the solutions in view of the green credit problems in the process of development in our country.One aim of this study is to promote green credit policies to develop into laws by using legal thinking and perspective to reasonably guide the course of the Banks’ capital and loans. We will increase support for green energy saving enterprise and reduce the financing degree of firms in dirty sectors so as to realize the green configuration of bank funds. Another aim is to research on green credit by means of economic means, administrative means, and legal means to implement the concept of environmental protection development in green credit and to build the harmonious society with green economy, green ecology, and green society.
