A Study On The Legal Protection Of The Right To Education Of Rural Scatterring Minorities

The construction in China has made great achievements since the 18~thh National Congress.With the gross domestic product rising from 54 trillion to 80trillion yuan,China has maintained its position as the world's second largest economy and contributed more than 30percent of global economic growth.However,it is necessaryto recognize that there are still many inadequacies in our country and many difficulties and challenges.China's poverty population still has a large population of 70 million people living in poverty.The poverty level is deeper and poverty alleviation is difficult.To build a moderately prosperous society in all respects by 2020 means that 291,000 people will be lifted out of poverty every month.Education poverty alleviation is the most direct,effective and sustainable poverty alleviation in poverty alleviation work.Xi general secretary repeatedly emphasized the poverty reduction in poverty alleviation will FuZhi because education can prevent intergenerational characteristics,most of the country's policies tend to be ethnic enclaves.Rural scattered ethnic minorities have their own rights and interests easily overlooked.The protection of the right of education of the rural minority group is of great significance for us to achieve the goal of building a moderately prosperous society in all respects.This article introduces the theory of the right to education of rural scattered minorities,from the perspective of Constiutionall Law.First of all,the definition and characteristics of rural scattered ethnic minorities are briefly described.The scattered ethnic minorities in rural areas refer to scattered ethnic minorities scattered in the vast rural areas of our country,with two characteristics of relatively living in habitability and poverty.Then the concept of the right to education,and the individual,complex,and impoverished nature of the right to education for ethnic minorities in rural areas are specifically elaborated.Finally,it analyzes the legal basis for guaranteeing the right to education of rural scattered minorities,and makes a summary of international law and domestic law,as well as its necessity.It is indispensable to ensure the education of rural scattered minorities,narrow the gap between them and developed areas,and guarantee their right to education.The author takes the rural scattered minorityvillage f and countryside Aof Hunan Province as examples.Through the analysis of the research method,the comparative research method,the empirical research method,and via the understanding of its basic situation,this paper further analyzes the achievements made by the ethnic minorities in their education,the actual situation of the right to education and the problems existing in guaranteeing the right to education in village f.For example,the policy inclination is not enough,and the national consciousness is not strong;the teachers are not enough;the quality of teaching is not high;teaching conditions and other infrastructure construction is not perfect.Finally this text,conceptsabout improving the right to education of scattered ethnic minorities in rural areas are from four aspects.First of all,in terms of legislation,it is necessary to formulate relevant special laws to guarantee the right to education of scattered ethnic minorities in rural areas,which is the premise;In administrative terms,we should also adjust the education policies of ethnic minorities,and attach importance to ensuring the right to education of rural scattered minority groups.In many cases,the guarantee of the right to education of rural scattered minorities is not much different from that of other well-developed villages in the local areas.Because our national minority education policy has always focused on the minority communities;the judicial aspect is to perfect the judicial remedy way.When the citizens'right to education is violated,they can carry on the constitution lawsuits.Finally,with regard to legal awareness,first,the government should step up publicity to let citizens understand the relevant policies so that our government's good policies can really be put into practice,and second,attention should be paid to the cultivation of the consciousness of scattered ethnic minorities.The national education needs not only to identify with the mainstream culture,but also to inherit and maintain the national culture,and properly handle the relationship between the integration of the mainstream culture and the preservation of the traditional culture of the nation.The"one kilometer"of"gnawing hard bones and breaking up forts"in poverty alleviation cannot be ignored.If the youth is strong,the country will be powerful;if the youth is ambitious,the national will be enterprising.We will ensure the right to education of rural scattered ethnic groups,strive to eliminate the poor roots of the poor,and strive to build a well-off society in an all-round way.
