Legal Guarantee Of The Right To Education Of Ethnic Minorities In China

The right to education is the basic right of citizens.The constitution of China clearly stipulates that "citizens of the People's Republic of China enjoy the right and obligation to education".For ethnic minority citizens,the right to education is not only a basic right of citizens,but also a national right.To ensure the realization of the right to education for ethnic minorities is of great significance for ethnic minorities themselves.With the development of social economy and the enhancement of education consciousness,the education security of ethnic minorities in China has made great progress.In order to guarantee the realization of the right to education of ethnic minorities,the state has issued the relevant legal norms of the right to education of ethnic minorities,which plays an important role in protecting the right to education of ethnic minorities.However,the education laws of ethnic minorities in China are not perfect,such as ethnic minorities The system of educational laws and regulations is not perfect,the level of laws and regulations is too low;the content of laws is too general,lack of provability;the legal operation of the right to education of ethnic minorities is not perfect;the legal form and language are not standardized;the theoretical research of ethnic education legislation is insufficient,and a series of problems make it difficult to implement the preferential measures determined by ethnic education policies,and the development of ethnic education needs Resources are not guaranteed.Therefore,with this series of issues to discuss,based on the theoretical research on the legal protection of the right to education of ethnic minorities,this paper has four chapters in total.In the first chapter,through the theoretical research on the right to education of ethnic minorities,the basic definition of the right to education of ethnic minorities is made clear,and the shortcomings of the current theory are analyzed.Through the summary of the right to education of ethnic minorities,the author puts forward his own opinions,At the same time,it also analyzes the content and particularity of the right to education of ethnic minorities,which makes the theory of the right to education of ethnic minorities clearer and provides theoretical support for the following research.In the second chapter,through the comparison of the right to education of ethnic minorities with the education data of other regions,we can see that there are some problems in ethnic minority areas,such as insufficient relief for students,insufficient level of teachers,backward educational facilities and insufficient financial relief.Then,from the perspective of law,the author analyzes the reasons for the lack of legal protection,and concludes that the legal protection of the right to education of ethnic minorities in China needs to be improved.In chapter three,through a comparative study of the legal protection of the right to education of ethnic minorities in the United States and Australia,the author reflects the lack of legal protection of theright to education of ethnic minorities in China,and analyzes the legal systems of the right to education of ethnic minorities in the United States and Australia,so as to improve the legal protection of the right to education in China The legal protection of the right to education of ethnic minorities can be used for reference.The fourth chapter,through the lack of research on the legal guarantee of ethnic minority education,reflects the urgency of the guarantee of the right to education of ethnic minorities in China,and needs to improve the legal system of ethnic minority education.The article tries to improve it through two ways,that is,the improvement of its own factors and external factors to realize the guarantee of the right to education of ethnic minorities,and promote the education in ethnic minority areas Finally,we will realize national equality,national unity and common prosperity.
