Research On Chinese Laborer's Right To Rest

The right as the basic rights of laborer,repeatedly confirmed by the constitution,the law around the world,it is not only a legal rights,which contains the attributes of human rights.In the context of rapid economic development in our country,the communist party of the eighteenth big clearly put forward to build a harmonious labor relations,to protect the rights of laborer rest and vacation,perfecting the relevant laws and regulations.However,in recent years,enterprises are not excessive labor to comply with the requirements of the labor law is very common,over work death tragedy,the phenomenon such as "996 weekly" constantly cause our attention to the problems of the right protection.This article is divided into three parts,the first part from the connotation of the right of the right research,analyses the features and the right to the country and what payment obligations shall be liable to safeguard the rights.At the same time,also from the right and decent labor relations,the right and the right to education the Angle of the two new studies the right for citizens,the state,society,the ultimate meaning of common development,to clarify the right protection of necessity.On the one hand,the protection of laborer counterpoises to make decent labor and decent life,maintain the modern basic human dignity;Ensure laborer,on the other hand,have plenty of time education itself,is conducive to the cultivation of high-quality talents to adapt to the social development.In this paper,the third chapter research analyzes the right protection in the administrative supervision and judicial relief problems,and put forward the perfect proposal.In the aspect of administrative law enforcement,should improve the mechanism of the prior supervision and law enforcement,and to rule out other local authority's improper intervention;In terms of justice,shallprovide direct way for workers to choose the judicial relief,and appropriately directed to the laborers in the proceedings.
