Research On The Legal System Of The Protection Of Women’s Labor Rights And Interests In Our Country From The Perspective Of Decent Work

Decent work is devoted to let the laborers under freedom and equality,security and dignity under conditions to obtain production of decent work. Women workers are an important indispensable force to promote the stability and development of society, so realize their decent work is an important part of decent work. Guarantee women the vulnerable groups to achieve decent labor problem has not only what a country or region need to face the problem, and has become a global social problems which every country must face and try to solve it. In recent years,with the rapid development of market economy in our country, with the labor market supply exceeds demand, women workers are facing increasingly serious employment situation, existing in the course of employment gender discrimination, with different reward, special protection is not in place, sexual harassment often makes women in a very disadvantageous position in the competition.Therefore, to establish and improve the protection of women’s decent work system is imminent with decent labor standards, the legal protection is an important part of realization of women’s decent work. Therefore, I from decent labor’s concept, evaluation standard, to our country woman of decent work status and on behalf of other countries and regions were comparative analysis,Then pointed out that there are many problems in the current laws and regulations of our country in protecting women’s decent work. At last,I proposed countermeasures and suggestions to perfect the China Women’s decent work legal protection in reference to Britain and the United States, Germany, Japan and China’s Hong Kong and Taiwan on the basis of the beneficial experience of the protection of women’s basic rights and special rights.This thesis is mainly divided into five parts, the first part starts from the concept and connotation of decent work of, then analyzes the decent work four basic measure,i.e., equal employment right, the basic rights in the work, social protection and social dialogue, and then analyzed the special requirements and necessary to realize women’s decent work of our country.The second part lists women in some representative countries and regions of decent work status, from which summed up some of the beneficial experiences. The third part in accordance with decent labor four basic measure is analyzed the present situation of our country women’s decent work.The fourth part from the legal security system level analyzes the reasons of lack of women’s decent work, mainly including the legislative concepts are bias andlag;many provisions in existing laws and regulations are too principle, so they are not convenient to operate in practice,;more legislative blank; existing legislation level is too low;the accountability mechanism is weak, judicial procedure is relatively complex, rights cost too high.In the fifth part, we put forward some suggestions on improving the legal protection system of women’s decent work in our country. Mainly to improve our country to protect women’s relevant legislative concept and legislative level; and improve the deficiencies in the existing laws and regulations, make up the related laws and supporting mechanism for the blank, and improve the corresponding legal liability to investigate the mechanism of, clear the subject of law enforcement,improve the proceedings.
