Research On EU's Border Protection Of Intellectual Property Rights

In recent decades,the global economy and technology develops rapidly,especially the generation of the Internet,which accelerate the process of globalization and trade liberalization.So international trade's impact is more and more important on nantional economy development.Every cuontry is increasingly focusing on the IPRs' border protection on international trade,because counterfeit and pirated intellectual property rights of infringement behaviors have taken place many times in goods or service transactions around the world.The outburst of first industrial revolution leaded to the result that the European Union has paid great focuse on the IPRs' border protection.Since then,the European Union began to constanly explore the IPRs' border protection.After years of explorations and practices,the European Union has formed a set of advanced and perfect system on the IPRs' border protection.Then,it brings enlightments to our country's IPRs' border protection.Compared with the European Union and the United States,our country started relatively lately on the IPRs' border protection,so there are still many deficiencies,such as the scope of border protection in our country is smallest,protection link falls behind,there is no better guarantee for the right to know of the parties,and the procedure for handlinginfriging goods is not simple,and so on.Therefore,our country should use our own advantages to learn the legislative experienace and advantages of developed countries and regions.So as to gradually perfect our country's the IPRs' border protection and make this kind of system in China be consistent with the level of developed countries and regions.And at the same time,it is suitable for the actual situation of China.Our government should take relevant legislation to expand the scope of protected parties,adjust the protection scope of the object,safeguard the right to know of the parties and establish the procedure for handling infriging.Our country's enterprises should understand the EU's rules and its changes,pay attention to the cultivation of awareness of protection for intellectual property rights and enhance our capacity for independent innovation.This paper mainly has five parts.The first part mainly introduces the research method,content,purpose,research background of this paper and the current research status at home and abroad of IPRs' border protection.The second part is an overview of the EU's border protection of intellectual property rights system,including the concept of the system and the EU's legal origin of border protection of intellectual property rights.The third part mainly analyzes four legislation and the development of the EU's border protection of intellectual property rights system.The fourth part compares the border protection of intellectual property system of European Union,the United States and China from three aspects.The fifth part is based on the government and the enterprise to analyze the EU's border protection of intellectual property right which brings the enlightments for our country.
