Compensation Right Of Urban Housing In ChinaJudicial Relief Research

With the development of the socialist marketization,the urbanization reform has been continuously advanced.This process is accompanied by the transformation of the old city and the construction of the municipal construction.The urban housing collection and compensation becomes an indispensable part,and the housing collection and compensation will be carried out smoothly,Must be legitimate and reasonable to protect the compensation of the expropriated person,to coordinate the relationship between the expropriation and the expropriated person,not because of compensation issues intensified contradictions,triggering social problems.And real life often occurs because of compensation issues caused by violence.The emergence of this series of events on the one hand,the government compensation is indeed not in place,on the other hand is the compensation for housing in China on the lack of judicial relief.Judicial relief on the one hand can restrict the government in the collection and compensation in the right,on the other hand as a neutral tripartite party can be the right to relief.This paper can be divided into four parts,mainly about the reality of the right of compensation for the collection of housing,in view of the lack of compensation for the compensation of the expropriated person,drawing on foreign related solutions,and put forward the judicial relief measures in line with China's national conditions.Secondly,there is the right to have relief,focusing on the description of today's society on the compensation for housing compensation for judicial relief analysis,as well as the shortcomings.Thirdly,it describes the status quo of judicial relief on the compensation right of housing in foreign countries,finds out the advanced and reasonable place of its relief,and thinks and draws lessons from the existing social environment in China.Finally,on the basis of analyzing the existing problems,drawing on the experience of advanced judicial relief in foreign countries,the paper puts forward reasonable suggestions in line with the reality of our country.
