On The Connection And Coordination Between Party Rules And State Laws

Legal norms system was juxtaposed with party regulatory system on the fourth plenary session of the 18 th CPC central committee and both served as major components of legal system with Chinese socialism.The session also mentioned that “put emphasis on the connection and coordination between party rules and state laws” when talked about strengthening construction of party laws and regulations.The realization of connection and coordination between party rules and state laws is inevitable requirement to improve the level of party management and governance,the way must be passed to promote the modernization of state governance system and capacity,prerequisite to build rule of law system with Chinese socialism and the only route to achieve organic unity between law-based state governance and regulation-base party regulation.Therefore,it is imperative to realize the connection and coordination between party rules and state laws.Party constitution is basic law of CPC while constitution is the basic law for the state.The tease out of relations between party constitution and constitutional law enables us to find that party rules and state laws tend to connect and coordinate with each other.The two also demonstrated promptness in response time,consistency in contents,highly coupling in values which accumulated experiences for future connection and coordination between them.However,there still exist disorder in management fields,clashes in management contents,dislocation in sanction methods.The root cause lies in inaccurate grasp of the relation between party rules and state laws,deficiencies in scientization and systematization of party rules and the lack of benign interaction between party rules and state laws.Therefore,the connection and coordination between party rules and state laws in practice requires us set the following principles in place: party rules should not contradict state laws,the former should be stricter than the latter and the benign interaction between them.At same time,we should establish and improve communication and coordination mechanism of legalization,connection and linkage mechanism of recording review,joint conference system for enforcement of law and discipline and perfect the post-implement assessment system of party rules.Only in this way could we handle properly the relations between party rules and state laws,achieve connection and coordination and make concerted efforts to help the construction of legal system with Chinese socialism.
