Research On The Realization Path Of The Connection And Coordination Between Inner-party Regulations And National Laws

Forming a complete system of party regulations is one of the important links in comprehensively advancing the rule of law.Since the fourth plenary session of the 18 th CPC central committee,the theoretical circle has paid more and more attention to the study of inner-party regulations.In order to make inner-party regulations play a more important role in national governance,how to link and coordinate inner-party regulations and national laws has become a major research topic that cannot be ignored by the academic circle.Now there is a lack of the sound mechanism to link and coordinate inner-party regulations and national laws.So it is necessary to study the realization path of the connection and coordination between inner-party regulations and national laws.This can make a little contribution for theoretical innovation and practical innovation in the connection and coordination of inner-party regulations and national laws.The CPC was founded nearly 100 years ago.For a long time,with the establishment and development of the CPC,inner-party regulations have been playing an important role in all phases of revolution,construction and reform.Inner-party regulations have the attributes of politics,law,duty priority and spillover,which are inseparable from the nature of the CPC.We need to have a correct understanding of the relationship between inner-party regulations and national laws.There are obvious differences between inner-party regulations and national laws in terms of formulation basis and system composition,formulation procedures,scope of application,formulation technology and standard requirements,and implementation methods.But they have the same value orientation and complementary normative functions.In terms of the connection and coordination between inner-party regulations and national laws,there are still some problems.First,there is no clear boundary between inner-party regulations and national laws.Second,inner-party regulations are not as impeccable as national laws in terms of formulation procedures and normative contents.Third,inner-party regulations concerning non-party cadres were not timely transformed.Fourth,inner-partyregulations and national laws are misaligned in means of sanction.Here are reasons for these problems.First,the relationship between inner-party regulations and national laws cannot be viewed correctly.Second,the linkage mechanism between inner-party regulations and national laws for record and review still needs to be adjusted.Third,there is a lack of coordination in the implementation of inner-party regulations and national laws.To achieve the goal which inner-party regulations and national laws can be well coordinated,we should take these measures.First,it is necessary to strengthen the interconnection between the formulation of inner-party regulations and national legislation.Second,we should deepen cooperation in the implementation of inner-party regulations and national laws.Third,we must promote the publicity of inner-party regulations and national laws simultaneously.In this way,we will be able to ensure that inner-party regulations and national laws are well coordinated and they will jointly promote the development and improvement of the system of socialist rule of law.
