Since the reform and opening-up,China lawyers on the quantity and quality have a larger increasing,a lawyer in all areas of society is playing an increasingly important role.Although our country's law about the provisions of the law rights for the system in the judicial practice also pay more and more attention to protect the rights of all the lawyers' practise,but in practice,lawyers' rights still exist many problems,especially in the field of criminal litigation.As a lawyer with law documents meeting being held,is often seen,they need to be held with the approval of the investigators.Some organizations do not arrange local papers for lawyers,and they are often restricted when they want to read all the cases.The lawyer's own evidence is difficult to obtain and is often rejected when applying to the authorities.In the process of trial,the lawyer should pass the judicial permission to put questions to the defendant,and the lawyer has not enough time to debate and they speak of time is often interrupted,right to a lawyer's practice is often hinder,it affected the function of lawyer.The author mainly discusses the status of lawyers in criminal proceedings.Then summarizes the current in the criminal lawsuit the plight of the lawyer's practice process,meeting with obstacles is emphasized,marking is restricted and investigation difficult problems,and discussing the lawyer rights is difficult to realize the reason,which focuses on analyzing the defect of traditional ideas and the criminal lawsuit system.The author mainly introduce the foreign meeting right,reading right and the right of investigation by introducing the main foreign countries about the provisions of the criminal lawyer rights.Finally,the author summarizes some measures to improve the situation of China.
