A Report On The Application Of The Labor Law In WuHan’s Taxi Industry

Taxi reached the Chinese market in 1903,the city of Harbin became the first one who held the new come transportation.By the late 1970 s,taxi gradually flourished throughout the country,and the history of the whole industry has experienced from the civilians “can’t afford Age”to the“wave to stop Times",from allow private capital into the market to use taxi-hailing platforms provide “tailored taxi service”.Due to the continuous expansion of the taxi number,labor disputes between taxi drivers and taxi companies come to people’s attention.In some places,comes the phenomenon such as taxi drivers refuse to take passengers,drivers’ strike and so on.As the Chinese taxi industry longterm accumulated contradictions and problems gradually emerging,the Internet brings new travel patterns are profoundly transforming the traditional ecology of the taxi industry,too.The cause of these disputes are rooting in the current situation which taxi industry labor laws implemented,what kind of legal relationship between taxi drivers and taxi companies should be,whether the legal rights and obligations in the present labor law between both sides can apply to solve these difficulties,is directly related to the healthy development of the taxi industry in the future.In order to promote the application of the labor law,and the healthy development of labor relations,the current taxi company labor rent mode need to be standardized,and the social security of the taxi industry should be improved.Based on the on-the-spot investigation in the taxi company in Wuhan,sorting out the current taxi industry related judicial cases,and analyse the current difficulties in labor law applicable taxi industry,I’d like to put forward the taxi industry labor law applicable mode,and some proposals to build harmonious labor relations of the industry.This paper aims to protect the legitimate rights and interests of the taxi driver,and promoting the sustained benign and healthy development of the taxi industry through the reform of related system.
