A Study On The Legal Regulation Of The Mission And Purpose Of Establishing Enterprise Foundation

By April 18 th of 2018,the total number of enterprise foundations in China is 868,accounting for 13.4% of the total number of national foundations.The development of enterprise foundation in our country can be said to be from nothing to existence,from little to more.In the future,the number of enterprise foundations will continue to increase with the increasing of entrepreneurs' willingness to feed back the society and the continuous concern of the public on philanthropy.The mission and purpose of the establishment of the enterprise foundation reflect the will of the founder.It affects the development of the enterprise foundation from the beginning of its establishment and covers all aspects of its activities,it is of great significance to the development of enterprise foundation.When regulating the mission and purpose of establishing the enterprise foundation,we should first sort out the different connotations of the mission and purpose of the establishment of the enterprise foundation.Generally speaking,the mission of the establishment of the enterprise foundation reflects the original intention and the specific direction of the establishment of the enterprise foundation.Method;the purpose of establishing an enterprise foundation is to refer to the scope of business in which the foundation is engaged.In addition,because the development of the foundation in our country is deeply influenced by the policy,the policy is,to some extent,the direction of the foundation.This paper also introduces the current legal system of the foundation in China.In order to see the mission and purpose of enterprise foundation legislative attitude.At present,the mission and purpose of establishing enterprise foundation in our country have not been well regulated,and there are some practical problems,such as: some enterprise foundations do not have the aim or the purpose is too broad,the mission and purpose of the establishment of enterprise foundation are mixed;The purpose is broad and the object of funding is not the purpose;the field of concern is piled up and the project design is homogenized;the purpose of the foundation is not related to the business of the enterprise.On the basis of the theoretical research on the financial corporation system and the restriction of the companyundefineds purpose,the author puts forward some suggestions for regulating the purpose and purpose of the establishment of the enterprise foundation,including: establishing the clear purpose,standardizing the specific purpose,and so on.Develop unique projects;integrate existing philanthropic resources;strengthen external oversight,etc.
