The prison population in China has ranked high in the world:the number of underage children of prison inmates has exceeded 700,000.These underage children are vulnerable to human rights violations and/or adverse social influences.As a result,they are in the need of additional attention and aids from our society.This paper investigates the basic rights of the children of 399 prisoners in south Fujian,China;it aims to reflect the status quo of the right protection for the children,understands the reasons for the insufficiency of the protection,and suggests means of improving the mechanism to better protect the children' s rights.In addition to the abstract and the summary,there are three chapters in this paper.Introduction introduces the study 'background,purpose and significance of this research.This includes the literature review,the selection of research concepts,the description of the research framework,and research methods.Chapter 1 The present situation of The Basic Rights of Minor Children Whose Parents being in Prisons in the South of Fujian Province.In this Chapter,we uses certain survey data to explain the status of the six major rights of the underprivileged group(the right to life,the right to education,the right to custody,the right to equality,the right to personal dignity,the right to participate)and indicates the problems.Chapter 2 The Reason Why The Basic Rights of Minor Children Whose Parents being in Prisons Are Difficult to Achieve.In this Chapter,we delineates the reasons for the difficulties the children encounter in rights protections from the angles of the legal,family,social,and policy levels.Chapter 3 Suggestions for The Rescue of The Basic Rights of Minor Children Whose Parents Being in Prisons.In this Chapter,we makes several realistic suggestions based upon the legal system and the societal status of China:the civil affairs department should become the primary administration of the rights protections of the unprivileged children.the country should encourage the development of social non-profit organizations and private charitable organizations;the judicial prison department should properly increase the labor compensation of prisoners to supplement family allowances.The government must adhere to the national policy of compulsory education and improve the education finance legislation;establish a temporary guardianship system and develop a foster care system in custody.All matters and legislation concerning children's rights and interests should be referred to the principle of protection of children's rights.Last but not least,in the aspect of the right to personal dignity,it is recommended to improve the privacy protection and so on.
