| At present,family disputes types are also complicated and diversified,the purpose of building a harmonious society is bound to pay attention to the resolution of disputes.Therefore,the Supreme People's Court has selected 118 grass-roots and intermediate people's courts nationwide to carry out a two-year pilot reform of the family trial mode and working mechanism from June 1,2016.Among them,the mediation system of family disputes is an important part of the reform.the system of family mediation and the special family trial procedure law are lacking in China,and the family dispute mediation system is still lacking of unified provisions and the family trial reform.Still in the exploratory stage,the establishment of family dispute mediation system in judicial practice still exists and more problems need to be improved.This paper will discuss the theory of family dispute mediation system and the specific problems in judicial practice,explore the improvement of family dispute mediation system and practical application,expecting our country can build a modem family dispute mediation system which can reflect the national cultural tradition and meet the needs of social development and lead the trend of future development.In addition to the foreword an conclusion,the text consists of three chapters.Chapter 1 Introduction of family dispute mediation,family dispute mediation plays an important role in protect the interests of underage children,resolve contradictions.in our judicial practice establishment of family case court introduce cooperation,there are still many shortcomings in practice.Chapter 2 The development of family dispute mediation system in other countries and regions and Its Enlightenment.Establish special family trial procedure law,attaching importance to the interests of minors has the reference significance to our country.Chapter3 Define standards for the selection of mediators,strengthening fact checking the optimization suggestion of family dispute mediation system in China. |
