Research On Gan Shang Commercial Mediation From The Late Qing Dynasty To Republic Of China

The commercial mediation system of the Gan merchants in the late Qing Dynasty to Republic of China,(1840-1949)was a model for the integration of Chinese traditional mediation culture with Western modern rule of law.It is of great theoretical and practical significance to conduct research on this.Mediation as a traditional Chinese dispute resolution method,with "human relationship" as the core concept,has long been rooted in the familial Chinese traditional rural society.During the period of late Qing-Dynasty to the Republic of China,with the gradual modernization of Chinese society,the commercial mediation system of the Gan merchants not only inherited the flexible and efficient characteristics of the original mediation system,but also absorbed the advantages of the voluntary and comprehensive Western rule of law,and became the important content of diversified dispute resolution mechanism in modern China.This paper focuses on the main body ? type ? basis and influence of the commercial and commercial mediation in the late Qing Dynasty to Republic of China.As the core of China's modern economy,Jiangxi is one of the few commercial priorities,and the unique commercial dispute resolution method of the merchants,the commercial and commercial mediation system,played an important role in the commercial activities at that time,and thus was of great research value.In order to better discuss the characteristics of the commercial mediation of the merchants,the author searches a large number of first-hand materials,and divides the mediation cases in different commercial fields into general commercial mediation and other by sorting out the newspapers,magazines and government documents during the late Qing Dynasty to Republic of China.There are two types of commercial mediation.At the same time,based on the collation of these cases,the rules and cases of commercial disputes are analyzed,and the basis for the application of the commercial and commercial mediation in the late Qing Dynasty to Republic of China is extracted,from the four aspects of national laws and regulations,guild regulations,business habits and customs.Analysis.Finally,it summarizes the influence and enlightenment of the commercial mediation of the merchants in the late Qing Dynasty,and provides suggestions for the current commercial mediation in China.In summary,the main problem that this paper hopes to solve is to answer what is the mediation of commercial and commercial affairs in the late QingDynasty to Republic of China,to fill the gap in the current academic circle in this field.It is more hopeful that in the interpretation,we can contribute to the development of China's “One Belt,One Road” economic take-off and electronic commerce by studying the mediation of commercial and commercial affairs in the late Qing Dynasty.
