Research On The Agricultural Product Geographical Indication

Every geographical indication will form an industry,rich people,and develop a regional economy.Making full use of the advantages of resources,declaring the trademark of geographical indications of agricultural products has become a new way of regional economic development,and an important force of regional economic development,especially county economic development.Based on the investigation of the trademark of the State Administration of Industry and Commerce on the geographical indications of agricultural products,this paper analyzes the present situation and existing problems of the geographical indications of agricultural products.Based on the case of navel orange in Gannan of Jiangxi Province,this paper probes into the definition of geographical indication infringement of agricultural products.The article is divided into four parts.The first part introduces the basic situation of geographical indications of agricultural products.It mainly refers to the concept of geographical indications of agricultural products,the distribution of geographical indications of agricultural products,the effects of geographical indications of agricultural products,and the basic implementation of the current system of geographical indications of agricultural products.This chapter will be introduced by researchers of Agricultural Geographical indications,mainly combined with the summary of predecessors and some data of the Trademark Office of the State Administration of Industry and Commerce in the process of agricultural geographical indications research.The second part mainly introduces the problems existing in the practice of geographical indications of agricultural products,although great achievements have been made in the protection and development of geographical indications,there are still some problems that can not be ignored.For example,the licensing and use of Agricultural Geographical Indications trademarks and the current market disorder,the weakness of Agricultural Geographical Indications in international registration,how to define the legitimate use of agricultural geographical indications trademarks,Agricultural Geographical Indications trademark use mode analysis,etc.In the third part,taking the case of navel orange in Gannan of Jiangxi Province as an example,the author discusses the definition of geographical indication infringement of agricultural products.The administrative case of the market supervision departmentof Jiangxi market involves the administrative punishment case of Gannan navel orange,Analysis of the administrative punishment cases of Gannan navel orange.The descriptive nature of the trademark of geographical indication,the rational use of the trademark of geographical indication and the constituent elements of the fair use of the trademark of geographical indication,etc.In the fourth part,the author puts forward some suggestions on the legal protection of geographical indications of agricultural products by analyzing the shortcomings of geographical indications of agricultural products and the case of navel orange in Jiangxi and Gannan.Straightening out the supervision mechanism,strengthening the registration of geographical indications of agricultural products,intensifying publicity,raising awareness of the protection of geographical indications of agricultural products,ensuring the quality of agricultural products and improving the competitiveness of agricultural products,We should promote the development of Agricultural Geographical indications,raise the level of brand internationalization,crack down on trademark counterfeiting infringement of agricultural products,play the role of trade associations,and strengthen industry self-discipline.Hope to provide some reference.
