Research On The Governance Of Social Groups' Leapfrog Petition

The petition work has always been an important bridge for the Party and the government to connect with the masses,an important window for listening to the voices of the masses,and an important way to understand the suffering of the masses.Since the18 th CPC National Congress,General Secretary Xi Jinping has issued a series of important instructions on the work of the petition and visit,stressing that the work of the petition and visit has a bearing on the immediate interests of the people and on social harmony and stability.The petitioners should focus on the center and serve the overall situation.New progress has been made in the work of social governance.With the promotion and deepening of the building of a moderately prosperous society in all respects,new issues and challenges are emerging,social transformation and contradictions are frequent.Petition has become one of the most convenient and efficient ways for the masses to solve problems.For some time now,there has been an increase in the number of petitions,which has caused a large number of social problems.The causes are complex,the contradictions are acute,and the behaviors are fierce.The petitions have even been used by illegal elements to seek illegal interests.The cross-level petition has become a topic that local governments can not open up and a social disease that is difficult to control.It consumes a lot of manpower,material resources,and financial resources,and greatly damages the image and credibility of the government.Under the circumstance that the situation of petition is still severe,how to improve the trend of petition and optimize the order of petition and petition,it is urgent to strengthen the thinking and research on the causes of petition and how to manage effectively,so as to provide effective and feasible governance practice experience.In2015,the "Letters and Visits Act" was established as a legislative research project by the State Council.In 2016,it was identified as a preparatory project.However,due to various reasons,the conditions for formulating the "Letters and Visits Act" are not yet mature.Some social groups have weak awareness of the rule of law,backward concept of the rule of law,and poor legal knowledge.When they encounter contradictions and disputes,they resort to the government according to traditional habits.When individual appeals are difficult to satisfy at the grassroots level,they will go up and go up to the level of petition.The rapid development of the economy and society,the unresolved old contradictions,the emergence of new contradictions,the work mechanism is still mature,the system is not sound,the in-depth concept of the rule of law and the improvement of the quality of the entire people and the improvement of the social environment still need a process,the governance of the level of petition will not be overnight.How to effectively manage the over-class petition and guide the petition to return to order is a social governance test that the government faces.The status of grassroots petition is particularly important in the work of national petition.H County is located in the northern part of Jiangsu Province and belongs to the underdeveloped areas of economically developed provinces.The economic base is general.For other problems such as rapid socio-economic development and structural transformation,the exploration experience of the over-level petition for governance is worth learning from similar regions.The author chose to exercise in the field of the letter and visit Department of H County for 6 months,participate in the first-line reception of visiting people,resolve difficult and complex letters and visits,collect and collate a large number of cases and materials for the people to go over the level of petitions,and conduct field research methods.A comprehensive analysis of information data and in-depth study of practice on the petition of the county H from 2015 to 2017;It has been found that there is an increasing trend of collective visits by social groups to provinces,concentrated areas of people's livelihood and profits,high rates of repeated visits to older households at higher levels,illegal petitions,and more advertisements to disciplinary inspection agencies.Through the study of social governance theory,it was found that the reasons for the formation of the over-class petition in H County include social background,institutional mechanisms,individual citizens,and grass-roots government service capabilities.The study found that the governance of the Hxian County has achieved remarkable results,effectively safeguarding the legitimate rights and interests of the people and social harmony and stability.Among them,third parties have intervened to resolve the law and petition matters.Consistent with the theory of good governance in social governance,it has a good effect on resolving difficult and complex petitions.At the same time,the study found that H County governance has also had practical difficulties,including the lack of credibility of grassroots governments and cadres,the failure of the construction of the petition team,the unscientific petition assessment mechanism,and the lack of judicial relief channels;There are still some outstanding problems,such as the lack of smooth complaint reporting mechanism,the wrong understanding of complaint reporting work,and the irregularities in handlingprocedures.We will put forward suggestions through research,address the issue of petition at the level of China and Vietnam,and maintain the order of petition and visit.Only under the guidance of the rule of law thinking and the rule of law,we will open channels and cooperate with multiple parties,and adhere to the principles of sunshine,responsibility and rule of law.It is the fundamental way to solve the over-class petition.In view of the author's limited level and short time,although the study found that the best way to solve the problem of over-petition under the framework of the rule of law,how to use the rule of law to promote the reform of the petition system is not accurate and clear ideas,and some specific issues are still not studied.There is no solution to how to strengthen the power of grass-roots governance and enhance the ability of grass-roots governance.It is hoped that it can be realized through future research.
