Investigation Of Dereliction Of Duty Infringement In Supervisory Premises

The place of supervision is a place where criminal suspects and criminals are specifically set up to be detained in accordance with national laws to ensure the smooth progress of criminal proceedings or the execution of penalties.It is necessary to punish judicial corruption and protect the human rights of the persons under supervision,and it is also an important means to strengthen the supervision of the execution of punishment and supervision activities.On November 2,2015,Cao Jianming,the chief procurator of the Supreme People's Procuratorate,pointed out in the "Report of the Supreme People's Procuratorate on the Supervision of the Execution of Penalties" at the 17th meeting of the Standing Committee of the Twelfth National People's Congress:"Since 2010,procuratorial organs throughout the country have investigated and dealt with 2,169 official crimes in the field of penal enforcement.Among them,there are more than 1,300 crimes involving dereliction of duty and infringement in supervisory places.Prosecutors have made remarkable achievements in investigating crimes of dereliction of duty and infringement of rights in places of supervision,but there is still a big gap compared with the National anti-corruption requirements.The author hopes that through the writing of this article,the author will analyze the particularity of the crime of dereliction of duty infringement in the supervision place compared with other duty crimes in the places involved,the crimes involved,the discovery of clues,and the penalties.Based on the author's practical experience,this paper summarizes the problems encountered in investigating the crimes of dereliction of duty and infringement of rights in supervisory places,such as weak investigation force,lack of clues,low case completion rate,imperfect investigation measures,and improper investigation methods.By analyzing the difficulties encountered in practice,the author puts forward some measures to solve them.First,we should strengthen the construction of investigation teams by matching them with strong investigators,improving the capabilities of investigation teams,and rationally allocating investigation resources.Second,improve the ability to collect and judge clues through multiple methods and multiple channels to collect case clues and improve the ability to determine clues.Third,by improving the investigation and evidence collection skills,improve the interrogation ability to examine the investigation skills;Fourth,we need to establish an integrated investigation pattern by giving full play to the role of the resident prosecutor's office,playing the role of criminal procuratorial function,and strengthening the unified dispatch of investigation work.
