Research On The Problem Of Personal Assistance Donate-Based Crowdfunding

In the context of "Internet+Charity",the personal assistance donate-based crowdfunding has become an emerging way in the field of charity.As a product of highly developed network and information,the personal assistance donate-based crowdfunding is mainly completed by the network platform,and has many obvious advantages in improving social assistance mechanism and maintaining social stability.However,there are still many problems in the process of its continuous development.At present,the establishment of the legal system for personal assistance donate-based crowdfunding is still in the initial stage of exploration.Subject to the characteristics of network virtuality,the authenticity of crowd-funding projects is difficult to measure.In addition,the network platform and the authorities have loopholes in the supervision of crowd-funding projects.The network fraud and donation incidents have emerged in endlessly,which has triggered a series of social problems.This article will focus on the personal assistance donate-based crowdfunding to explore its main problems,and put forward corresponding suggestions based on individual independent thinking.The research of this paper is divided into five parts.The first part elaborates the development background and research significance of personal assistance donate-based crowdfunding,as well as the domestic and international research status in this field,which provides theoretical basis and research direction for the subsequent discussion.The second part mainly expounds the meaning and classification of crowd-funding,donate-based crowdfunding and personal assistance donate-based crowdfunding,and gives the position of this article on personal assistance donate-based crowdfunding,that is,it is a private fundraising but has public characteristics.The third part focuses on the current situation of the operation of personal assistance donate-based crowdfunding in China,including the operation process of the personal assistance donate-based crowdfunding project,the rights and obligations of the help-seekers,the donate-based crowdfunding platform and the donors.Through comparison,it analyzes and summarizes the current risk control measures of representative crowd-funding platforms in China.Finally,it use the questionnaire survey to find out the public participants' understanding and evaluation of personal assistance donate-based crowdfunding.The fourth part expounds the problems of personal assistance donate-based crowdfunding,including:First,the lack of legislation,no specific and specific legal provisions to restrict personal assistance donate-based crowdfunding behavior;second,the role of relevant authorities is vague,and the regulatory responsibility for personal assistance donate-based crowdfunding is unclear;third,the crowd-funding platform has not taken up responsibility for reviewing crowd-funding projects,monitoring the flow and use of funds throughout the process;fourth,the participation of both parties in the personal assistance donate-based crowdfunding is too random;fifth,the overall supervision of the society is weak.Finally,the fifth part of the article mainly proposes corresponding suggestions and measures for the existing problems.The main countermeasures are as follows:First,clearly define the personal assistance donate-based crowdfunding behavior and the rights and obligations of each participant from the legal point of view,and standardize the accountability mechanism;second,the competent authorities should play a guiding and supervising role,assist the platform to manage crowd-funding projects and increase the cost of illegal activitiesis;the third is to strengthen the self-restraint of the crowd-funding platform,to monitor crowd-funding projects before,during and after the event,and to fulfill their responsibilities;The fourth is to regulate the participation behavior of both parties from the perspective of both the helper and the donor;fifth,the non-governmental organizations and the news media should be united to create a social environment conducive to the healthy development of personal assistance donate-based crowdfunding.
