Crowd financing projects,crowd financing projects such as water drop and Tenc ent public service,have rapidly flooded people’s vision and become the main force of the new charity financing mode of Internet plus charity.Driven by the Internet,this m ode develops rapidly and becomes a powerful supplement to the social assistance mec hanism in China.However,in the process of rapid development of donation crowdfun ding,there are also many new problems.Although the introduction of the charity law in 2016 made up for many legal gaps in the field of charity,it excluded the subject qu alification of individual donation crowdfunding projects.Internet donation crowdfund ing is only applied by analogy through existing laws,and its supervision is not compr ehensive and perfect.Recently,the event of "Ditui" of water drop fund-raising has put donation crowdfunding platform into a hot spot.Therefore,this paper mainly focuses on the legality of Internet donation crowdfunding and the supervision of donation cro wdfunding platform.This paper mainly studies the development status of Internet donation crowdfund ing,defines and differentiates the related concepts of Internet donation crowdfunding,analyzes and summarizes the legal problems of Internet donation crowdfunding in Ch ina through practical cases,further analyzes the problems,and puts forward suggestio ns for improving the legal regulations.The first part describes the background,research significance and research status at home and abroad.The second part compares and analyzes the meaning and related concepts of Inte rnet donation crowdfunding and traditional charity,.Through the analysis of the legal relationship between Internet donation crowdfunding subjects,the legal status and fun ctions of donation crowdfunding platform are clarified;the main functions of Internet donation crowdfunding are analyzed to demonstrate the necessity and importance of d onation crowdfunding.The third part is in the current situation of China’s legal regulation,through the c ollection of data on the development of charitable organizations and donation crowdfu nding platform in China,the classification and operation mode of the platform are ana lyzed,and it is clear that donation crowdfunding platform is a network operator with b oth public welfare and commercial nature,as well as the legal issues arising from the operation of the platform.The fourth part mainly analyzes the problems and causes in the practice of Intern et donation crowdfunding in China by combining cases,mainly focusing on the legalit y of Internet donation crowdfunding with the attribute of individual help seeking,the operation mechanism of Internet donation platform and the problems in its external su pervision.The fifth part puts forward suggestions on improving the legal regulation of Inter net donation crowdfunding in China,mainly in the aspects of legislation and supervisi on,including improving the relevant legislation of Internet donation crowdfunding,cl arifying the subject qualification and behavior legality of individual donation crowdfu nding,clarifying the responsibilities and operation norms of Internet donation crowdf unding platform,strengthening the external supervision of the platform,and promotin g The orderly development of Internet donation crowdfunding.
