The submarine area outside national jurisdiction has enriched biological and genetic resources due to low temperature and no light environment,and plays an important role in human medical and other fields.In recent years,with the continuous development of science and technology,the international community has gradually recognized the importance of biological resources in the region.Some developed countries press to maintain the principle of freedom of the sea.On the other side,some developing countries have argued that the biodiversity in deep seabed beyond national jurisdiction is the common heritage of mankind and therefore the benefits derived from it must be shared among all nations.Nowadays,whether UNCLOS and CBD,or other international laws about the biodiversity in deep seabed beyond national jurisdiction has no definite regulations.The author tries to introduce the development of the protection of the biodiversity beyond national jurisdiction,introduce the meaning and legal connotation of the principle of human common inheritance,and analyzes the principle of human common inheritance for the use of the principle of common inheritance of human beings.Finally,the author takes proposals like improving the environmental impact assessment system,constructing marine protected areas,constructing benefit-sharing system and biodiversity compensation system.
