| Under the background of the rapid development of biotechnology,genetic resources has gradually become one of the indispensable strategic resources of the national development.Genetic resources play an important role in the field of environment,health,agriculture,economic and so on.The important value of genetic resources makes increasingly fierce competition for genetic resources in developing countries,to produce bio-piracy behavior.The value of genetic resources and its own characteristics has caused the spread of bio-piracy.Genetic resources are distributed in unbalance and irrefragable.Bio-piracy behavior has caused a series of problems such as environment,economy,resources loss in developing countries.Therefore,how to protect the genetic resources become an international legal issue to be resolved.As one of the important means to protect the genetic resources,to study the access to genetic resources and benefit-sharing system has important value whether in theory or practice aspect.According to the relevant provisions of the international legislation,developing countries should perfect domestic legislation to establish national sovereignty of genetic resources,regulate the access behavior of developed countries,ensuring developing countries to share the benefits fairly to protect genetic resources in developing countries.Because of the advantage of geography and climate conditions in our country,genetic resources are very rich and vast.However,we suffered some bio-piracy issues.At present,the law of access to genetic resources and benefit sharing system in our country is legal blank,and in the initial stage,needing to be improved.Therefore,we need to draw lessons from foreign legislative experience,combined with the genetic resources of the specific situation in our country,to strengthen the legal protection of genetic resources in our country and realize the rational utilization of genetic resources and sustainable development. |
