Research On Copyright Of Artificial Intelligence Creations

Artificial intelligence is a computational study aiming at exploring and understanding the mysteries of human intelligence and making perception,reasoning and action possible.With the advent of artificial intelligence creations,it seems that"creation"is no longer the exclusive ability of human beings.In this paper,the copyright of artificial intelligence creations is the core of the research.On the basis of fully comparing the similarities and differences between artificial intelligence and human creation,the property of artificial intelligence creations ’ rights is demonstrated.Based on the legislative response and judicial practice standards of various countries on copyright protection of artificial intelligence creations,this paper tries to give an answer to the position and scheme of copyright protection of artificial intelligence creations in China.In the first chapter of this paper,starting with the generation process of AI products,the similarities and differences between AI generation process and human creation process are compared.The author believes that the existence of the legal subject is the premise of the effective ownership of the rights of AI products,and the"thought"which is hard to verify should not be used as the judging factor of the copyright attributes of artificial intelligence creations.Integrating artificial intelligence creations into copyright protection has strong feasibility.The economic and social benefits generated by the dissemination of artificial intelligence creations can not be ignored.In the second chapter of this paper,based on the basic theory of copyright law,demonstrates whether artificial intelligence creations conform to works in the sense of copyright law.Artificial intelligence and human intelligence have the same logical basis,and its creatures objectively conform to the criteria for identifying the originality of works.In addition,the existing artificial intelligence creations and human works belong to the same field,with a fixed carrier and replicable form for effective transmission.Artificial intelligence creations belong to works in the sense of copyright law objectively.In the third chapter,after comparing the legislative response and judicial practice of copyright protection of artificial intelligence creations in various countries,the author puts forward the position and principles of copyright protection of artificial intelligence creations in China at this stage,and tries to respond to the practical arrangement of integrating artificial intelligence creations into the protection of the Copyright Law of China.
