The Social Impact Of International Criminal Trials

After the second wrld war,the international community began to establish international criminal trial to deal with crimes arising from large-scale armed conflicts.Different from the simple domestic criminal trials,the international criminal trials are aimed at a wide range of war crimes.The number of parties involved is very large,and the scope of the influence of international criminal trials has also been expanded.Therefore,the international criminal trials will also make an impact on a wide range of parties in the trial of war criminals.The various decisions made by the court may affect the parties' views on war and justice.From this perspective,the international criminal trials should not only adhere to the principle of fair,but also pay attention to the possible impact of its own trials on the post-war society and the international community.This paper focuses on the social impact of international criminal trials,the first part starts from the Tokyo trial and clarifies the influence of the Tokyo trial in Chinese and Japanese society.The second part analyze the causes for its limited influence on the basis of the first part.The next part introduces the contemporary international criminal trials and finds out their progress on the basis of the comparison with Nuremberg and Tokyo trials.On the basis of the comparison,the fourth part points out the inherent defects of the international criminal trial because of its nature.The last part summarizes the foregoing,clarifies the general social influence of international criminal trial on the basis of recognizing its inherent defects,and propose ways to expand its social influence.In short,this article focuses on the external influence of international criminal trials,then strives to find out its defects and role on the post-war society.On this basis,this paper will put forward some suggestions to expand the social influence of international criminal trial.
