With the establishment and continuous improvement of the socialist market economy,people's economic level has been greatly improved,and the scope and mode of property control are also changing quietly.The problem related to the livelihood has become a top priority to solve of our country.Especially in recent years,the problems of high housing price,chaotic housing rental market and excessively high rent keep emerging one after another.The issue of housing security has draw more and more attention from the security.At present,how to guarantee citizens' right to housing in the critical period of social transformation has become an urgent problem to be solved.For that,some scholars in China began to put forward measures to limit the housing rent to protect the residents' basic right of residence.The housing rent control system has existed in many countries,and such emergency measures to limit the maximum tent have played a vital role in guaranteeing citizens' basic right of residence in the special period of each country.The Unite States is particularly typical,whose rent control system has been existed since the first word war and has more than 100 years old.Although the rent control system in the Unite States has not been smooth in the whole process of evolution,with ups and downs,from a wide range of popularity to the last few areas to remain,its positive role in the two world wars and the financial crisis to the country is still indisputable.it is tempting to wonder way America's rent-control system has been so controversial,why it worked through two world wars and the financial crisis,and why it has survived its current decline.Now,whether the rent control system should be implemented in our country are very controversial,but,if through researching on the housing rent control system of America,we can get some beneficial experience for the perfection,the rent control,the balancing of interests of our housing rent system,which is smart action.This paper is divided into the following parts:The first part mainly introduces the housing rent control system in the Unite States,including the meaning of housing rent control,the background of the implementation of rent control in the Unite States and the historical evolution of the system.The second part introduces the main contents of American housing rent control system.Including the form of rent restrictions,the rent control,the limitations of application,the restriction on repossession by lessors.The third part tells about the challenges to the rent control system in America.This partdescribes the pressure on the implementation of rent control system in the Unite States,which is questioned by scholars about whether the system is constitutional,legitimate,effective and fair.Although controversial,some scholars highly support the system and believe that is necessary and feasible to implement it.But supporters have always been outnumbered by opponents of rent controls.After the 1980 s,the district rent control system was gradually abolished.Up to now,only a few areas still have the housing rent control system.The forth part mainly expounds the reason why rent control system can still be effective despite the controversy.This part mainly explores the reason form the changes after the transformation of the Unite States housing leasing law and a series of measures to restrict the rights of lessors.It can be seen from the study that the development of the rent control system in the Unite States is not smooth sailing.Despite various twists and turns,it is still able to survive and play an important role in a few states,which is enough to prove that the system has its merits and is worthy of detailed exploration and reference.The fifth part carries on the above content and draws inspiration from the overall study of the American rent control system.Although it does not completely copy the American system,it can always provide beneficial reference for the improvement of China's housing leasing laws,for example the rent control,coordination and protection of the interests of lessors and lessees.
